PAYG Withholding Variation: Client Applications
Reduce a client’s PAYG withholding only on a supported basis. Prepare the variation application and check the approval before payroll changes.

A PAYG withholding variation changes how much tax a payer withholds so it better matches your client’s expected annual liability. Prepare a supported application, then change payroll only when the payer receives the ATO notice covering the payment.
When a PAYG Variation Fits
Apply for a downward variation when normal withholding would exceed the client’s expected tax liability, such as where supported rental deductions reduce taxable income. The Australian Taxation Office (ATO) determines the variation from the information supplied.
Lower withholding gives the client more cash during the year. Their final tax still depends on the income and deductions in their tax return. Approval does not establish that a claimed deduction is allowable.
Separate the client’s request from these other changes:
- A changed tax-free threshold or repaid study loan can belong on a withholding declaration. Use that route when the employee’s declaration needs updating.
- An agreement to withhold extra tax is an upward variation. The employee can arrange it in writing with the payer.
- PAYG instalments are payments towards tax on business and investment income. An instalment variation follows its own procedure.
Correct case: apply to the ATO for reduced withholding based on supported annual deductions. Incorrect case: tick an approved-variation box because the client expects a refund.
Choose the Application Route
Choose the form by the payment and reason for the variation. The ordinary application is PAYG withholding variation application, NAT 2036.
Application Choices
| Client circumstance | Application route | Check before preparing it |
|---|---|---|
| Annual income or deductions justify changed withholding | NAT 2036 | Include income from all payers and the reason for the reduction |
| Business income or non-commercial business losses | NAT 2036 with supplement NAT 5423 | Apply the non-commercial loss rules before using a loss |
| Allowances or an eligible study-loan overpayment or approved deferral | Short application NAT 5425 | A repaid loan can also require a changed declaration to stop future extra withholding |
| Senior Australian receiving payments from multiple payers | Senior Australians application NAT 5424 | Confirm the form’s eligibility conditions |
| Nominated foreign-resident activity payments | FRWV application NAT 11097 | Use the separate activity-payment procedure below |
The ATO’s application instructions set the eligibility requirements and application-year cut-off. A late-year application can apply to the next income year. Select the intended year before entering any figures.
The ATO does not process the ordinary application for CFD, share-trading or cryptocurrency losses. It also excludes first-year small-business or partnership losses and donations that have not been made. Working holiday makers have a separate residency and treaty assessment within the application instructions.
Before preparing a client application, record authority to act. Confirm the payer’s legal name, ABN and pay-office postal address. Obtain the payroll ID and pay frequency, then reconcile the latest payslip to gross pay and withholding received so far. Include previous payers in the year-to-date totals.
Resolve outstanding lodgments and debts before applying. The ordinary application requires all required returns and activity statements to be lodged, or the relevant non-lodgment notification. It also requires no outstanding government tax or other ATO-administered debt. A debit assessment for the last year in which a variation applied can prevent processing.
Support the Annual Estimates
Estimate the client’s full-year liability using all expected income, then deduct only amounts supported by the client’s facts and records. Include payers whose withholding will remain unchanged.
Fictional Annual Workpaper
Assume an adult Australian resident for all of 2026-27. The client has appropriate private hospital cover throughout the year. Tax offsets and study-loan repayments are excluded. All deductions below are assumed allowable.
| Workpaper item | Full-year estimate | Evidence to request |
|---|---|---|
| Salary from main payer | $100,000 | Employment terms, payslips and expected remaining pays |
| Wages from second payer | $10,000 | Second job’s payslips and roster estimate |
| Bank interest | $2,000 | Statements and expected interest |
| Gross rent | $18,000 | Lease and property-manager statements |
| Total assessable income | $130,000 | Reconciliation of every income source |
| Rental deductions | $28,000 | Interest, expense records and any depreciation schedule |
| Work-related deductions | $2,000 | Receipts and work-use calculation |
| Estimated taxable income | $100,000 | $130,000 less $30,000 |
Using the ATO resident tax rates, income tax is $20,520: $4,020 plus 30% of the $55,000 above $45,000. The assumed full 2% Medicare levy adds $2,000, giving an estimated liability of $22,520.
Suppose the client’s combined payslip projection shows $28,000 annual withholding, including $7,000 already withheld. That leaves an estimated $15,520 to collect after allowing for the $7,000 credit. The $5,480 difference from normal projected withholding explains the application. These are fictional withholding projections, not a quoted payroll rate or guaranteed refund.
Keep actual withholding to date separate from future withholding estimates. If only one payer will apply the variation, account for expected withholding from the other payer before assessing the remaining amount.
Omitting the second job understates income and can produce a tax shortfall. Inflating rental deductions has the same effect. Include only the client’s ownership share, separate private expenses and explain any material difference from the previous return.
An income tax calculator can support the annual comparison. Keep its liability estimate separate from the rate the ATO ultimately directs payroll to use.
Lodge and Review the Outcome
Lodge the supported application through the ATO’s documented channel, then read the actual decision before instructing payroll.
- Open Online services for agents and select Lodgments, then Client forms, then PAYG withholding variation. A self-lodging individual uses their linked ATO service through myGov, under Tax, then Manage.
- Select the application year and reason. Complete the payer information and the applicable income and deduction sections. Use the supporting workpaper to reconcile annual totals with year-to-date pay.
- Review the declaration with the client and obtain the authority needed to lodge. Retain the completed application and lodgment reference. If online lodgment is unavailable, order the appropriate paper form through the ATO’s publications service.
- Respond to any ATO information request with the relevant evidence. The ATO can request receipts, loan records or an explanation of a deduction before or after processing.
- Read the outcome for the named payee, covered payer and payment types. Record the approved rate or amount and the operating period, then confirm the payer receives its notice.
Before lodging online, enter the payer’s ABN without spaces and use the payroll postal address, which can differ from the workplace. Include every income payment type you want covered. Leave irrelevant income fields blank where the instructions require it. For an application before the income year starts, do not enter the previous year’s pay as current year-to-date income.
The ATO aims to process online applications within 28 days and paper applications within 56 days. An information request can extend processing. Lodgment or a client’s requested rate does not authorise a payroll reduction.
If the employer cannot find an approved notice, its Online services for business Communication history can contain a copy. The ATO’s instructions explain how the payer can request another copy after the stated waiting period.
Apply the Approval in Payroll
Use the approved withholding variation only for the payer, payment types and period stated in the ATO notice. The varied withholding starts from the next available payday after the pay office receives that notice.
In Xero, “Has Approved Withholding Variation” identifies the employee’s approved variation treatment. Xero’s Australian payroll specification records an approved withholding variation percentage separately from an additional dollar amount for upward withholding. Enter the approved percentage only when it matches the notice. Selecting the field does not apply to the ATO or create an approval.
If the notice requires treatment that a single percentage cannot express, calculate each covered payment according to the notice. Keep normal withholding for payment types outside its scope. For example, a salary variation does not automatically cover a bonus or employment termination payment.
First-Pay Checks
- Match the employee and employing entity to the notice before editing the employee’s payroll tax details.
- Record the approved treatment and identify the first eligible payday. Save the notice with the payroll record.
- Compare the draft pay’s covered gross payment and tax against the notice. Check any separately taxed bonus or allowance independently.
- Confirm the final payslip contains the expected deduction and record the reviewer’s check. Set a reminder for expiry.
For a fictional notice directing 20% withholding on $2,000 of covered gross wages, the check is $400. A bonus outside that notice needs its own withholding calculation. Use a TFN tax calculator for a separate ordinary-pay comparison where its inputs fit.
If someone enabled the variation without authority, first check whether the payer holds a valid notice. If none exists, remove the unauthorised setting and calculate future pay under the applicable normal treatment. Review affected pays and correct any withholding or reporting errors through the payroll correction procedure. Notify the client of a resulting shortfall. If a valid notice exists, follow its terms and ask the ATO to resolve any uncertainty about scope.
Keep the variation notice with business records for five years. An ATO withdrawal notice ends the varied treatment from the next available payday. An employee’s request alone does not withdraw an existing notice.
Review Changes and Expiry
Reassess the variation when income or deductions change, and use the notice’s expiry as the payroll end point. The ATO requires a new application for changed circumstances during the income year.
A higher salary, unexpected bonus or changed rental expenses can alter the annual estimate. Selling a rental property can remove the basis for reduced withholding. A new payer needs its own covered variation before applying reduced withholding.
Refresh the full-year estimate using actual pay and withholding so far. Reconcile the remaining liability and submit the revised information through the applicable application route. Payroll continues to follow the operative notice until the ATO changes or withdraws it, or it expires.
Ordinary variations generally cover one financial year. Some allowance variations cover multiple years, as stated in the outcome. Diary renewal early enough to obtain the next notice before expiry. If the current notice expires first, use normal withholding until a new notice takes effect.
Foreign-Resident Activity Payment Variations
Use the PAYG foreign resident withholding variation (FRWV) application for nominated activity payments to a foreign-resident recipient. The nominated payment categories cover the following activities.
- Entertainment or sports activities.
- Construction and related activities.
- Casino gaming junket activities.
Construction includes building, installation and upgrading work and related activities. Casino junket payments reward bringing people to a casino to gamble. Entertainment and sports can involve a group or entity, as well as an individual performer. Classify the actual payment before choosing the form.
A foreign vendor’s property disposal follows the separate FRCGW variation procedure. The FRWV activity-payment form does not replace it.
Prepare and Lodge the FRWV Application
- Obtain written authority from the foreign recipient and confirm the applicant’s entity and tax residence. Complete the payee details and the agent or representative section of NAT 11097.
- Collect each payer’s identity, ABN and notice address. Record expected gross payments and Australian taxable income for the application year, including relevant non-cash benefits. Identify the first and final expected payments.
- Support deductible expenses with an estimated income and expense statement. For a sportsperson or entertainer applying on this ground, attach the performance contract. Include the TFN required for a deduction-based application.
- If relying on a treaty, identify the country and article and explain why the actual income qualifies. For a domestic exemption, state its legal basis. Address identity evidence where a TFN or ABN is not required.
- Calculate the anticipated Australian tax and requested withholding rate. The instructions require the requested rate to be rounded up to two decimal places. Explain how it follows from the supported income and expenses.
- Obtain the applicant’s signature on the taxpayer declaration and complete the representative details, including the tax agent registration number. Retain the client’s authority with the application and attachments.
- Lodge using the FRWV instructions. They provide the postal route and designated email channels, including the sports and entertainment channel.
The printed form requires the applicant’s signature even where another person prepares it. An agent’s written authority and completed representative section do not replace that declaration.
NAT 11097 covers one financial year. Payments spanning income years require a separate application for each year. Use the official form’s lodgment cut-off and leave time for the decision before the relevant payments.
Verify the Payer’s Deduction
Check the FRWV decision against the covered recipient and payers, payment category, approved treatment and operating period. The ATO sends the payer its official notice. The recipient’s approval letter is a separate document and cannot authorise the payer’s variation.
Until the payer receives its notice, it must continue the applicable normal withholding. Compare the first covered payment’s actual deduction to the notice, then retain the notice and calculation. Review later changes and the end of the approved period before making another payment at the varied rate.
