Income Used in the Calculation
Division 293 tax is 15% of the smaller of the relevant contributions and the amount that income plus contributions exceeds $250,000. This Division 293 tax calculator estimates the additional tax for an accumulation fund.
Start with taxable income after deductions. Add total reportable fringe benefits, net financial investment loss, net rental property loss and the net amount subject to family trust distribution tax. Subtract zero-rate taxed super lump sums and assessable first home super saver releases included in taxable income.
Use your client’s tax return and income statements, with rental and investment schedules supporting the loss amounts. Reportable super contributions are excluded from this income measure because contributions enter separately. Missing a loss add-back or a fringe benefit can understate the estimate.
Contributions Included in Division 293
Enter employer contributions, including super guarantee and salary sacrifice, plus personal contributions claimed as a deduction across all funds. Deduct the confirmed excess concessional contributions separately. After-tax non-concessional contributions are outside this calculation.
A larger contribution cap from carried-forward amounts does not remove those contributions from Division 293. Enter the full concessional total. This tool does not calculate your client’s available cap or determine the excess.
Where the ATO disregards or reallocates excess contributions under its discretion, those amounts retain concessional treatment for Division 293. Keep them in contributions and remove them from the excess field.
The comparison holds income fixed. Salary sacrifice or a deductible personal contribution can also change taxable income. Recalculate the income input for that separate position before treating the tax change as the effect of a contribution strategy.
A Worked Division 293 Estimate
These fictional cases assume no income adjustments or excess contributions. At $210,000 income and $30,000 contributions, the combined $240,000 is below the threshold. Estimated Division 293 tax is $0.
At the default $240,000 income and $30,000 contributions, the combined $270,000 exceeds the threshold by $20,000. Tax applies to that smaller amount, giving $3,000. Changing contributions to $20,000 gives $1,500, a $1,500 reduction with income held fixed.
At $270,000 income and $30,000 contributions, Division 293 applies to the full $30,000 contribution. The estimate is $4,500. Once the full contribution amount is taxable, further income increases do not increase that contribution’s additional tax.
Checking the Result Against the ATO
Compare the income and fund contribution figures on your client’s assessment with the workpaper. Check the income year first, then each income adjustment and each fund’s reported contributions. A later fund report can lead to an amended assessment.
Download the CSV workpaper to reproduce the Division 293 tax calculator in Excel. It includes every entered amount, both scenarios, the threshold comparison and the estimated tax. Its final row contains spreadsheet formulas using the exported cells. The displayed tax rounds to whole dollars.
The browser estimate excludes defined benefit contribution calculations and deferred debt accounts, including interest and end-benefit caps. It also excludes special rules for constitutionally protected state office holders and Commonwealth judges, certain rollovers and former temporary resident refunds.
Use the ATO’s Division 293 calculation guidance for those circumstances. Your entered figures stay in the page without uploads or browser storage. Clear figures removes them from the tool, and Reset example restores the fictional defaults.
