ACNC Registration for Accountants 2026
Preparing an ACNC registration application? Check the charity’s eligibility, subtypes, governing document and Responsible People before client approval.

ACNC registration recognises an eligible organisation as a charity in Australia. Before you prepare the application, establish its legal identity, check its governing document and connect each proposed subtype to its activities. Keep the client’s approval with the final application and attachments.
What ACNC Registration Establishes
The Australian Charities and Not-for-profits Commission (ACNC) is Australia’s national charity regulator. Charity registration establishes the organisation’s registered charitable status and approved charity subtypes. Incorporation creates the legal entity, while the Australian Taxation Office (ATO) decides tax-concession and deductible gift recipient (DGR) endorsement.
Use the ACNC eligibility criteria to check the organisation before accepting the registration work:
- Confirm not-for-profit status in the governing rules and actual operations.
- Assess whether its purposes are charitable and for the public benefit, apart from purposes incidental or ancillary to those charitable purposes.
- Establish how it meets the applicable Governance Standards and, for overseas operations, External Conduct Standards.
- Identify any disqualifying purpose, such as promoting a political party or unlawful activity.
- Check legal-form eligibility. Individuals and partnerships cannot register, and political parties and government entities are excluded.
An organisation can earn a surplus and remain not-for-profit when it uses that surplus for its charitable purposes. Describing an organisation as community-minded does not answer the eligibility questions.
The ACNC uses the organisation’s ABN as its unique identifier and issues no separate ACNC registration number. An active ABN alone does not prove charity registration. Search the Charity Register for registered status and retain the organisation’s incorporation identifier separately. For a proposed company, resolve the forming a company limited by guarantee before preparing its charity application.
Check Whether a Charity Fund Needs Registration
Establish whether the charity fund is a separate trust or money set aside within an existing charity before choosing the applicant. A fund name or separate bank account does not establish a new organisation. The ACNC trusts guidance explains how trustees manage assets for beneficiaries and which trusts can register.
Ask for the trust deed or fund rules and identify who holds the assets and controls their use. Compare those records with the operating charity’s governing document and ABN record. For a separate trust, identify the trust’s own purposes and ABN, keeping the trustee’s identity separate. The ACNC legal-structure guidance explains how the governing document and ABN entity type must agree.
For example, a fictional registered charity earmarks donations for literacy classes under its existing constitution. If no separate trust or other entity has been created, record the fund within that charity’s file. Do not prepare another charity-registration application merely because the appeal has its own name. The ATO’s guidance on funds within an entity distinguishes these funds from separate trusts.
Not-for-profit registration and charity registration answer different questions. Incorporating a not-for-profit organisation does not establish that its purposes are charitable. Before choosing subtypes, record what the fund is established to achieve, who benefits and how its grants or other activities further those purposes. Identify any private-benefit restrictions or non-charitable purposes that need resolution. The ACNC charitable-purpose guidance connects the governing objects and actual activities to registration eligibility.
Settle whether the proposed DGR request concerns the applicant itself or a fund it operates before preparing the request. The ATO decides DGR endorsement separately from ACNC charity registration. Choosing a charity to donate to is a donor’s task. For the client’s application, retain the fund classification and supporting records that explain which organisation applies.
Check the Governing Document
Obtain the complete, final governing document and all amendments that form part of it. A constitution usually governs a company, rules govern an association and a trust deed governs a trust. A working draft is not the attachment to lodge.
Record the clause or page supporting each check:
- The legal name agrees with the ABN record and incorporation documents.
- The objects explain the charitable purposes the organisation actually pursues.
- The not-for-profit provisions govern use of income and assets during operation.
- The winding-up provisions direct remaining assets to charitable use or another charity as required.
- The rules explain decision-making and the responsibilities of members and Responsible People.
The ACNC governing-document guidance explains which instrument to provide. Resolve a mismatch between legal form and ABN entity type before completing the application. Do not select a different legal form just to get past the mismatch.
An ACNC template constitution helps identify clauses for a small public company limited by guarantee with straightforward membership. Choose the version suited to the proposed charity and DGR position. These templates are not designed for associations or proprietary companies limited by shares.
Use a template to assess or prepare the client’s document, then arrange any required legal review and formal adoption. A downloaded template does not establish that the client has adopted those rules. Keep adoption evidence with the final instrument.
The governing document will generally be public. If it contains personal contact information, provide the full document and an appropriate redacted copy under ACNC guidance. A withholding request needs its own supported reason.
Choose the Charity Subtypes
Choose ACNC charity subtypes from the organisation’s purposes and activities, supported by its governing document. The subtype guidance explains each category’s legal meaning. A possible future activity is not a reason to claim its subtype now.
For each proposed subtype, write a short file note identifying the purpose clause, relevant activity and intended beneficiaries. Add the budget or program document that supports the explanation. If the proposed subtype has no matching purpose or activity, resolve that gap before seeking the client’s approval.
For example, a fictional organisation runs literacy classes for adults and has an education object. Its application can explain how the classes advance education. A possible future health program does not establish a current health purpose.
A Public Benevolent Institution (PBI) is a distinct charity subtype. Its assessment considers whether the organisation is an institution organised, conducted or promoted to provide benevolent relief to people in need. Broad community benefit alone does not establish that subtype.
The ACNC PBI guidance also separates PBI registration from ATO endorsement. To obtain DGR endorsement under the PBI category, the organisation needs that ACNC subtype and must satisfy the other ATO requirements. Prepare the separate DGR endorsement assessment where the client requests it.
Collect the People and Activity Records
Identify every Responsible Person from the organisation’s governing body. For a company, this means its directors. For a trust with a corporate trustee, include that trustee company’s directors. The accountant preparing the application does not become a Responsible Person merely by acting as agent.
Use the ACNC Responsible People guidance to reconcile the list with the governing document and appointment records. Collect names, birth dates, residential addresses, contact details, positions and appointment dates. Check the required number of Responsible People and retain suitability-check results.
Prepare the remaining answers against the registration application checklist:
| Application area | Records to collect |
|---|---|
| People | ACNC and ASIC disqualification checks, relevant personal relationships and past-person checks if seeking backdating |
| Activities | Current work and plans for the next 12 months, beneficiaries, purpose served, time allocation and estimated spending |
| Locations | Australian and overseas operating locations, fundraising details and relevant permits |
| Finances | Estimated current-year revenue, funding sources, expected sources over the next 24 months and financial year end |
| Governance | Conflicts procedures, safeguarding arrangements, financial management and accountability to members |
Ask about money or resources sent overseas as well as staff working abroad. ACNC overseas guidance covers work through overseas partners and small overseas activities. Keep partner agreements and resource-use arrangements with the application evidence. Assign the ongoing assessment through the ACNC governance standards guide.
Prepare the ACNC Application
Start the application only after the entity records and supporting documents agree. Use this order to keep authority and client approval clear:
- Confirm the engagement covers charity registration and identify who can approve the organisation’s answers.
- Obtain written authority to act. The ACNC agent-authorisation guidance provides suggested wording for the documents the agent will submit.
- Use your own Charity Portal account under the official application instructions. Portal accounts belong to individuals, so use your own sign-in details.
- Prepare the application from the agreed entity record. Include the establishment and requested registration dates, final governing document and supporting evidence.
- Resolve the tax-concession and DGR answers with the client. Retain existing decisions and pending request references before choosing a new request.
- Give the client the completed answers and exact attachments for approval. Record who approves them and any changes, then submit the approved version.
- Retain the confirmation email and case number. Allocate responsibility for responding to ACNC questions.
The application allows requests for income tax exemption and relevant fringe benefits tax or GST concessions. The ACNC sends new concession requests to the ATO after charity registration. Confirm the person acting is authorised for ATO purposes too. The ACNC declaration alone does not establish ATO authority.
For DGR, identify whether the request concerns the whole organisation or a fund, authority or institution it operates. Prepare the relevant category and supporting schedule where required. Do not repeat a DGR application already submitted to the ATO or another government department.
The ACNC application FAQs confirm that existing concessions and DGR endorsements do not need another application. If an answer changes after submission, contact the team handling the case. The submitted application cannot simply be edited in place.
Retain the Registration Decision
Retain the ACNC’s registration confirmation and check the approved registration date and subtypes against the application. Keep the final answers, attachments, client approval and subsequent correspondence together. Record any difference between the requested and approved position, with an owner for the next action.
Keep an ACNC certificate of registration supplied with the charity’s records as evidence of its charity registration. The company or association’s incorporation certificate establishes its corporate or association registration. Keep those documents under separate descriptions so a later reviewer can distinguish them.
For current charity-registration evidence, search the ACNC Charity Register by name or ABN and retain the result. The ACNC’s current application guidance also explains its confirmation email and permitted statement of registered status. A certificate retained from an earlier period does not replace a current status check.
Track the ATO decision separately if tax concessions or DGR endorsement remain pending. An ACNC approval does not close that part of the work.
Give the Responsible People a written handover identifying who monitors ACNC correspondence, maintains records and handles changes to the charity’s details. Allocate the Annual Information Statement preparation and financial reporting and assurance work to named roles in the engagement. Close the registration task when the decision is filed and each continuing obligation has an agreed owner.
