TFN Declaration Form: Employer Checks

Before the first pay, check the employee’s TFN declaration form. Find the official PDF or online option and complete the employer’s part.

A TFN declaration form tells an employer how much tax to withhold from an employee’s pay. Before the first pay, obtain the employee’s completed declaration, resolve inconsistent answers and match payroll to it. Use the ATO’s online or paper route.

Get the Official TFN Declaration Form

The Australian Taxation Office (ATO) identifies the paper tax file number declaration as NAT 3092. It starts withholding arrangements with a payer. Applying for a first TFN is a separate task.

The ATO’s paper declaration guidance says the downloadable form is no longer available. Order paper copies through the ATO publication ordering service or phone 1300 720 092. Order only the quantity you need.

An editable, fillable or printable TFN declaration PDF found elsewhere can be an old edition. Saving the ATO instructions as a PDF does not create the declaration. Its self-print specifications are for compliant software, and include a sample PDF. Give the employee the employer’s approved electronic form when one is available.

Otherwise, an employee with a TFN can use ATO online employment forms. They need a myGov account linked to the ATO and the employer’s ABN or withholding payer number. After completing the declaration, they must print the employee tax details summary and give it to the employer. Employees without a TFN, or claiming an exemption from quoting one, must use the paper declaration.

Who Completes Each Part

The employee completes and signs Section A of the paper declaration. The employer completes Section B when paper lodgement is required. Compliant electronic reporting supplies the employer information through the software.

Before acting for your employer client, obtain their authority for the payroll work and any reporting you will undertake. Confirm that your access covers the correct employer entity.

Ask the employer for their ABN or withholding payer number, branch details where applicable, legal name, address and payroll contact. Obtain the employee’s completed declaration and commencement details. Establish which payroll reporting route the employer uses and who retains the original record.

The declaration is one part of the new employee forms pack. Keep the super choice form as a separate payroll handover item.

Check the Employee’s Answers

Check that the declaration identifies the correct employee and payer, contains the required answers and is signed and dated. The employee owns their tax choices. Your payroll work applies the answers they declare.

AnswerPayroll consequenceCheck before entering it
Residency for tax purposesDetermines the withholding treatment, including foreign resident or working holiday maker treatmentUse the declared category. A home address alone does not decide tax residency.
Tax-free thresholdChanges ordinary withholdingEnter the employee’s choice. Another job does not automatically decide the answer.
Study or training support loanCan require extra withholding under the applicable tablesUse the employee’s declaration or online summary. Employment type alone does not establish a loan obligation.

In a hypothetical payroll handover, an employee ticks the tax-free threshold box but tells the payroll contact they meant to leave it unclaimed. The contact must return the inconsistency to the employee. Obtain a corrected declaration before entering the disputed choice. Changing the payroll answer without a matching declaration leaves two conflicting records.

The employee can use the ATO’s tax-free threshold guidance for multiple jobs to decide their choice. Keep personal advice about their other income separate from the employer’s payroll instructions.

Handle Missing or Changed Details

A blank TFN requires a reason. Establish whether the employee claims an allowed exemption or declares that they have applied for a TFN or enquired about an existing one.

An application or enquiry declaration gives the employee 28 days to provide their TFN. Apply standard withholding during that period. Track its expiry instead of leaving the temporary treatment in payroll indefinitely.

Without a TFN, exemption or declared application or enquiry, withhold 47% for a resident employee or 45% for a foreign resident employee. Ignore cents in the withholding amount. The same treatment applies after the 28-day period expires unless the ATO directs otherwise. Do not apply tax offsets, Medicare levy adjustments or additional study-loan withholding under this treatment.

If no valid declaration arrives within 14 days of starting the employment relationship, notify the ATO. STP Phase 2 reporting can supply the employment and tax information with the applicable tax treatment code beginning in N. Alternatively, complete a declaration with the available employee details and send it to the ATO. These routes and withholding rules appear in the ATO’s withholding schedule.

The TFN declaration date records when the employee makes the declaration. Keep it separate from their start date and the day you enter payroll. A declaration applies to payments made after the employer receives it.

For a later change to the tax-free threshold or study-loan answers, use the withholding declaration, NAT 3093. The employee must already have supplied a valid TFN declaration. An updated declaration replaces the previous one, so retain the earlier record and update the next applicable payment.

Finish the Employer’s Duties

Complete the payroll handover in this order.

  1. Obtain the signed declaration or ATO employee tax details summary. Resolve missing answers with the employee and document any missing-TFN treatment.
  2. Enter the employee’s declared tax details in payroll. Compare the selected treatment with the declaration before releasing the first pay.
  3. Complete the applicable reporting. STP Phase 2 includes the declaration information, so retain the declaration without sending a separate copy. An ATO online summary also needs no separate submission. If separate paper lodgement is required, complete Section B and send the original within 14 days of signature or employer completion.
  4. Retain the completed record and any reporting acknowledgement in the employer’s restricted payroll file. Record who checked the payroll treatment and any follow-up still due.

The ATO’s payer obligations distinguish these reporting routes. A routine pay event and a separate declaration lodgement are different actions. Confirm the employer’s reporting method before treating the pay event as sufficient.

The ATO allows clear, unaltered scans of signed paper records. Apply its event-based retention rules.

  • When an employee supplies a replacement declaration, keep the earlier form until the end of the following financial year.
  • For an employee unpaid for 12 months, retain the last declaration until the end of the financial year following the year they were last paid.

Other payroll records can have different retention requirements.

Keep TFNs in the Right Place

The employer and practitioner must protect TFN information wherever each holds it. The Office of the Australian Information Commissioner’s TFN Rule guidance requires restricted access for staff who need it for an authorised purpose.

Explain why you collect the TFN, the law permitting collection and the consequences of withholding it. Refusing to quote a TFN is not an offence. Use secure collection and transfer, and keep paper records locked away. Avoid ordinary email attachments containing completed declarations.

Tax Genie applies this approach to practice client onboarding. TFNs stay hidden until a staff member reveals them, and each reveal is logged. TFNs stay out of AI review, exports, emails and generated documents. Employee declaration collection and reporting remain part of the employer’s payroll handover.

Set a retention review for each completed payroll record. Once lawful retention and permitted use no longer require the TFN information, securely destroy it or permanently de-identify it. Include duplicate scans and downloads in that review, so a cleared payroll file does not leave a copy on someone’s desktop.
