Certificate of Residency: Requesting One for a Client
Before a client claims tax treaty relief overseas, get their certificate of residency from the ATO. See what to collect, how to apply and common delays.

To request a certificate of residency for your client, complete the ATO’s residency request form and send it through Practice mail in Online services for agents. First confirm the client’s tax residency, lodged returns and the document their overseas payer accepts.
What a Certificate of Residency Proves
An ATO certificate of residency confirms Australian tax residency for a stated period, allowing an overseas authority to assess a tax treaty claim. The ATO also confirms that the applicant is not a temporary resident and is liable for Australian tax on worldwide income.
Your client might need it for foreign dividends, interest or royalties, a foreign pension or an overseas payer’s residency requirements. The certificate supports the claim. The applicable treaty and the foreign country’s rules decide the relief.
Specify the country and period the payer needs. The ATO’s request forms allow several countries on one application and provide one copy for each country. A client receiving income from two countries can therefore need two country-specific certificates without making two separate applications.
Check the Client is an Australian Resident for Tax Purposes
Establish residency for the requested period before completing the application. For individuals, the ATO uses the resides, domicile, 183-day and Commonwealth superannuation tests. The resides test considers the client’s living arrangements and connections with Australia. Meeting another test can establish residency when the resides test does not.
A visa or Australian citizenship alone does not settle tax residency. An Australian tax resident can also have temporary-resident status, which prevents this certificate being issued for that period. Use the ATO’s individual residency guidance to assess both questions.
A company incorporated in Australia meets the domestic incorporation test. A foreign-incorporated company must carry on business in Australia and meet the central management and control test or the Australian-resident shareholder voting-power test. The ATO’s company residency guidance explains the distinction.
Compare those facts with the lodged returns covering the requested period. The ATO’s forms state that a certificate will not be provided where the applicable return does not self-assess the client as a resident. Correct an inaccurate return through the proper amendment procedure before requesting inconsistent certification. A resident answer on a part-year return does not prove residency throughout the whole year.
If the client is also resident in another treaty country, resolve the treaty residency question first. The ATO’s dual-resident guidance sets out the relevant advice or determination route.
Requesting the Certificate as the Client’s Agent
Send the completed PDF request through the client’s income tax account in Online services for agents. You must have authority to act and access that account. If the client has not added your practice, follow the agent nomination steps first.
- Download the ATO’s Certificate of residency and certification of overseas tax relief form. Use NAT 75441 for an individual or NAT 75442 for a non-individual.
- Complete the client identifiers and contact details. Match the name, TFN or ABN and relevant address to the ATO’s records. Select which identifier appears on the certificate.
- Choose a certificate, certification of the foreign authority’s form, or both. Select every required country and the period. The period options include an income year, calendar year, one year from issue or a custom period. Consult the ATO’s request instructions for advance-request limits.
- Complete the residency and lodgment sections, including any applicable ruling or competent authority determination reference. Enter the postal address for delivery to your practice and complete the agent declaration. Online requests do not require a signature on the request form.
- Open Communication, then Practice mail. Select Income tax as the topic and Certificate of residency as the subject. Attach the completed request and any foreign authority form or supporting explanation, then retain the sent message.
- When the certificate arrives, check the client’s name, country and coverage period against the payer’s request before sending it overseas.
Record the income type, payer and reason for relief in the practice file and any supporting explanation needed for the foreign form. The standard ATO request PDF has no separate income-type field.
The ATO’s individual request guidance aims to complete requests within 50 days. High volumes can extend that time. Documents go to the postal address entered on the request, so allow for delivery before the payer’s deadline. For other account tasks, use the Online services for agents guide.
Foreign Authority Forms and Treaty Claims
The ATO certifies residency on an overseas tax relief form when Australia has the required tax treaty with that country. Without a treaty, its guidance says it supplies a certificate and returns the foreign form uncertified. Residency certification does not approve every other statement or calculate the foreign refund.
Before requesting either document, obtain the payer’s requirements in writing. Establish whether it accepts the standard ATO certificate, requires its own form or needs an original certified document. Complete the client’s parts of the foreign form and include every page the authority requires. An electronic request can still require an original foreign form.
For a hypothetical example, an Australian resident receives dividends from a company in a treaty country. The payer requires evidence for the dividend period before applying treaty treatment. You confirm residency and return lodgments, request the document the payer accepts and send the issued certificate before its cutoff.
If the payer has already withheld tax, ask about its correction or refund procedure. Do not assume later certification automatically changes earlier payments.
Residency Facts to Collect When a Client Comes on Board
Ask about overseas income and residency connections during the first engagement so the certificate request starts before a foreign payment is due. Collect the following information with the tax return records.
- Each foreign income source, payer, country and income type.
- Foreign tax identification numbers and any foreign tax-residency declarations.
- Visa status, temporary-resident facts and relevant spouse details.
- Travel records showing time in and outside Australia, with the reason for each absence.
- Homes, family connections and employment or business ties affecting residency.
- The payer’s required document, coverage period and withholding or refund deadline.
Flag foreign income for assessment of whether a certificate is needed. Keep the request, issued certificate, certified foreign form and payer correspondence together. At the next return, confirm the income and residency facts again before reusing the records. An old certificate does not establish residency for a new period.
When the ATO Delays or Refuses a Request
Match the delay or refusal to the application and the client’s ATO record before sending another request.
| Problem | Check | Corrective action |
|---|---|---|
| Lodged return shows a different residency position | Compare the return with the facts for the requested period | Assess whether an amendment is required. Resolve the inconsistency, then request the supported period. |
| Returns are overdue | Inspect outstanding income tax lodgments | Lodge the required returns with the correct residency position before making a fresh request. |
| Entity details do not match | Compare the form with ATO names, identifiers and addresses | Update incorrect records or correct the form, then submit the completed request. |
| Foreign form comes back uncertified | Read the ATO’s response and check treaty coverage | Address missing information or use the standard certificate where accepted. |
For a request beyond the indicated processing period, contact the ATO with the sent-message details and supporting documents. Avoid duplicate requests while an existing application remains under consideration.
Tell the client what has delayed the certificate and whether the payer will continue withholding meanwhile. Retain payment statements and foreign tax evidence. Confirm any overseas refund deadline immediately, and send the corrected certificate request only when the underlying issue is resolved. A statement of tax record is a different document and cannot replace proof of residency.
