An ABN application lets a registered tax or BAS agent register a client through the Australian Business Register or Business Registration Service. You can also arrange GST, PAYG withholding and a business name. Confirm the applicant and keep the client’s authority before lodging.
How an Agent Lodges an ABN Application
Apply online through the ABR’s tax professional services using myID or another supported Digital ID. The Business Registration Service handles combined registrations. The ABR’s agent instructions require you to be registered as the client’s agent.
An ABN application through the ABR is free. Your service fee and any ASIC business name fee are separate costs. Explain them to the client before starting.
- Confirm the legal applicant and its entitlement. Record who instructs you and their authority to act for the entity.
- Collect the entity’s legal name, relevant TFNs, dates of birth, residential and business addresses, contact details and associate details. Obtain the business activity, commencement date and expected turnover.
- Obtain the client’s written declaration that their information is true and correct. Keep it with their authority, because the client remains responsible for their answers.
- Enter the applicant and business details, then select the required registrations. Complete the agent declaration and save the issued ABN or application reference.
If you need to stop, save the application. The ABR gives you a reference number, password and expiry date. Use those credentials to return before expiry. The saved information is lost after that date, so put the displayed deadline in your work list. The ABR saving instructions explain this return route.
Collect missing information before reopening the application. Tax Genie collects entity registration details and checks client answers before your practice lodges through the official service.
ABN Entitlement: Check Before You Apply
For a business applicant, establish that the client carries on an enterprise or has taken real steps to start one in Australia. The ABR entitlement guidance also recognises Corporations Act companies and supplies connected with Australia’s indirect tax zone.
Employment, a hobby or a private one-off sale does not become an enterprise because someone wants an ABN. An isolated commercial venture can require a different assessment. A proposed business with no commencement activity needs further facts before you lodge.
Describe what the client supplies, to whom and how they earn income. For a partnership starting a cleaning business, describe commercial cleaning services and retain quotes, equipment invoices or signed service contracts. Avoid a vague description such as general services that hides the activity.
The ABR can ask for evidence supporting the start date. Retain records of actual preparation, such as insurance, premises, equipment purchases or bids for work.
Choose the Right Applicant
The ABN belongs to the applicant conducting the activity, so identify that applicant before collecting registration details.
| Applicant | Details to establish before lodging |
|---|---|
| Individual | The individual’s identity and authority. Use the dedicated sole trader ABN guide for their entitlement and application steps. |
| Partnership | The partnership’s legal name, partners and commencement details. Each partner’s own registration is separate. |
| Trust | The trust’s name and type, its establishment details and the trustee acting for it. A corporate trustee and the trust have different records. |
| Company | The incorporated company’s legal name and ACN, plus its directors, public officer and required shareholder details. |
For a company that does not yet exist, complete registering a company before applying under that company’s identity. A business name does not create a company or change who holds the ABN.
Partnership and Trust ABN Applications
A partnership application identifies the partnership and its partners, while a trust application identifies the trust and its trustee. Collect the details from the entity records rather than relying on the client’s trading name.
For individual partners, obtain each name, date of birth and TFN or residential address. For entity partners, collect the legal name, relevant ABN or other registration number and TFN or address and formation date. Record the partnership’s start date. The ABR associate rules distinguish individual and organisation details.
For a trust, obtain its name, trust type, deed date and trustee details. Have the signed deed available before applying so you can confirm the trust exists and identify the correct trustee. Keep trust establishment work separate from the ABN application.
A partnership or trust needs its own TFN when it has income-tax reporting obligations. The partners’ or trustee’s TFNs do not replace the entity’s TFN. A registered tax agent can request the entity TFN during the ABN application where eligible. Refer income-tax registration work outside a BAS agent’s scope to a tax agent.
If the client asks you to register a partnership company, obtain a definite instruction before lodging. For a partnership, you need the partner identities, agreement or other formation records and commencement details. For a company, you need incorporation instructions, shareholders, directors and the resulting ACN.
Follow the partnership sequence once the client chooses it.
- Settle the partner identities and commencement date.
- Collect authority and evidence of the enterprise.
- Apply for the partnership ABN and request its TFN through the appropriate agent.
- Register a business name if the partnership trades under a name requiring registration.
- Match every confirmation to the partnership’s legal identity.
Ordinary partnerships differ from limited partnerships and incorporated limited partnerships. Business.gov.au’s partnership guidance directs those entities to state or territory registration requirements. Resolve that registration before treating the entity as ready for its ABN application.
Adding GST to the ABN Application
Select GST in the combined application when the client must register or has instructed you to register voluntarily. The general GST turnover threshold is $75,000, or $150,000 for non-profit bodies. These are turnover thresholds, not fees or profit limits.
Assess expected turnover under the ATO’s GST registration rules. Some activities require registration regardless of turnover. Use the GST registration guide for the full threshold calculation and registration decisions.
Record the effective GST registration date and reporting cycle as soon as confirmation arrives. Assign responsibility for the first BAS and use the BAS due-date guide to set the work deadline.
Registering the Client for PAYG Withholding
PAYG withholding registration must precede the client’s first payment from which tax must be withheld. This includes employee wages and some other payments. Personal drawings by a sole trader or partners do not become wages merely because money leaves the business.
- Ask whether the client will employ staff or make another payment subject to withholding. Obtain the first pay date, expected payroll and estimated annual withholding.
- Select PAYG withholding in the combined registration application. If the ABN already exists, add the registration through the official tax registration route or authorised agent services.
- Save the registration confirmation and withholding cycle. Put the resulting IAS or BAS reporting and payment dates in your work list.
The government PAYG registration guidance explains the before-payment rule. Prepare payroll for Single Touch Payroll reporting and assess super guarantee obligations before the first pay run. PAYG registration alone does not complete either task.
Adding a Business Name to the Application
Add a business name when the client trades under a name that requires registration rather than its legal name. The Business Registration Service combines this with the ABN route and can also accept an ABN application reference for a business name application.
Record the registered business name against the correct ABN after ASIC confirms it. Check that invoice details identify that entity and that tax records use the same holder. The business name can differ from the legal name without belonging to a different taxpayer.
Use the business name registration guide for availability checks, registration and renewals. An old trading name entry is not proof of a registered business name.
ABN Application Status and Processing Time
Many successful online applications issue an ABN immediately. A reference number means the application needs checking or further information. The ABR aims to review these applications within 20 business days.
- Retain the reference number and submitted application details.
- For a Business Registration Service application, return to Resume or track your application and select the relevant application type.
- For an ABR application, use the reference when contacting the ABR about progress. ABN Lookup shows issued public records and cannot explain a pending application.
- Respond to a request for identity or enterprise evidence using the reference and the instructions provided.
A delay can reflect unmatched identity details, incomplete associate information or a need to establish entitlement. Send the evidence that resolves the actual issue. Once issued, use the ABN and TFN checking guide to reconcile the ABN record with the client file.
Refused Applications and ABN Reactivation
An unsuccessful application can result from missing entitlement, identity details that do not match ATO records or incomplete information. Read the refusal letter and retain the refusal number before deciding what to do next.
Correct a factual error with evidence. If the client disputes the decision, contact the ABR and preserve their objection rights. The ABR objection procedure allows 60 days from receipt of the decision. State which decision the client disputes and why, with evidence of the enterprise.
For a returning client, identify the cancelled ABN and confirm the same entity is restarting. Reapply through the official ABN application route using the earlier details. This allows the existing registration to be matched instead of creating a duplicate taxpayer record. A changed entity needs its own application.
Do not treat a cancelled ABN as active while reapplication is pending. Recheck GST and PAYG withholding separately. For a deregistered company, the ABR requires ASIC re-registration before ABN reapplication.
Apply for the Client’s ABN and Linked Registrations
Use the combined ABN and TFN route for an eligible separate entity, then confirm each linked registration under the same applicant. The ABR TFN instructions for agents cover companies, partnerships and trusts. Sole traders use their individual TFN and cannot obtain one through this combined business application.
If the client needs only an entity TFN, use the entity TFN application guide instead of beginning an unnecessary ABN application.
Consider a hypothetical client who leaves employment to run a sole trader business, expects $90,000 GST turnover and will trade under a separate business name. Identify the individual as applicant, assess GST registration and add the business name registration. Their individual application details belong in the sole trader guide.
Check that the issued ABN names the correct applicant. Every requested registration needs confirmation and effective details. Assign an owner to the first reporting tasks. Retain a pending reference as pending until the official decision arrives.
